Asbestos on Fire at WTO !!
 

I take this opportunity to submit a report about the Asbestos Case at the WTO We were quite unaware of the details of happenings at the WTO. However we were assured that the best experts were at work and the judgement shall be 50 : 50 ie. half in favour of Asbestos and half against it.

Inspite of our repeated submissions to AIA & AIC, of a lot of strong, positive, scientific, authentic and reliable data on Asbestos which could have easily won the case, it was ignored !!

Chronologically arranged events.

1. At my first AIA Mtg in Jun 1999 at London : I submitted / presented to the Director Mr Bobb Pigg a lot of strong, positive, scientific, authentic and reliable data on Asbestos which he liked and requested for copies to be distributed to all. Copies were promptly arranged but not distributed !!. I requested for a 2 minute presentation and I was refused by the Chairman.

1. At my first AIC Mtg in Jan 2000 (& since then) : I presented more data & suggested that we should be involved in the WTO case too. : I was laughed at and informed that they are experts with all data available.

2. In April 2000, I met the Commercial Officers at the Canada High Commission at Delhi and talked to them about the Asbestos Facts and they took the documents assuring that they shall be used / sent at the required place.

3. At the Moscow AIA Mtg in May 2000 :

a.on hearing about the WTO case , I asked why it was being fought on incomplete grounds and informed about the other important (winning) parameters : I was ignored and the panel moved on to the next item.

b.I presented still more data & this time the Chairman said that this is not in the agenda and the Data is not required

c.Promptly thereafter, The Director of Asbestos confirmed that this was very much in the Agenda , thanked me for the data and requested others to do the same too. !!

4. At the AIC Mtg. On 15th May Morn. At Delhi : The WTO issue was not mentioned. The preliminary judgement was to be out by 13 June.

5. In the Afternoon I informed the Canada High Commission (CAH) about my prediction that the WTO Judgement shall be against Asbestos and offered them the Data again for the counter (By email also).

6. I visited to the Ministry of Commerce and their WTO section to seek their advise and I was informed about some details of the case & that WTO is quite a closed body.

7. By that time the news was known that the WTO Judgement was totally negative !!

8. CAH assured me that the offer & email shall be forwarded to the right people and that they would soon get in touch with me directly if needed. They also indicated that about 5 weeks shall be available for counters.

9. On 16th , I also wrote to Mr Piere Desmarais of the Canada Govt.(person dealing with this issue

10. On 17th I wrote to WTO (enquiry & publication - only 2 available emails on their website !!), but did not receive any reply from them

11. On 20th at Hyd.Mtg. This issue was not in the agenda and I did not feel like taking it up either

12. I had discussed it earlier with Mr Tayal & thereafter with Dr Vivek also and urged that he discusses it with Mr Pattabhi, which he confirmed having done later that day

13. On May 23rd I realised that only 2 weeks are available for counters & the last day for the same is 27th

14. June No reply had come from Canada Govt. or High Commission etc

15. I was suggested that it would be better if I prepared a submission / counter and submit it personally thru Canada Govt. if possible at WTO Geneva. I agreed and decided to leave for Geneva immediately / a s a p

16. Accordingly I again wrote a detailed note presenting the case counter, to Asbestos Institute, Canada High Commission and several connected officials in the Can Govt. but no reply recd

17. Also informed verbally and email to Dr Vivek who assured discussing it with the concerned members

18. On reaching Geneva(26th June) I contacted the Canadian Mission at Geneva, who informed that they are aware of my offer but have still not received any info about it from Ottawa where the lawyers / concerned people are and leaving the submission copy with them would not be of use. I tried to contact the Ambassador and some seniors but couldn't . Left messages & my mobile no. but they didn't call back.
